ADVOCATE VIJAY KURLE, SEEKS DISCIPLINARY ACTION AGAINST SENIOR ADVOCATE ASHISH KAMAT FOR HIS AMATEUR TRICKS IN PROTECTING WHITE COLLARED SCAMMERS

Recently Advocate Kurle wrote to ‘Bar Council of Maharashtra & Goa’ seeking action against Senior Advocate Ashish Kamat for his juvenile conduct to delay prosecution of scammers of thousands of crores of government and insurance policyholder’s funds by private insurance companies and their senior officials.

  Top private insurance companies, cheated the government and small-time policy holders, through the following dubious means -

A. Enrolling ghost beneficiaries and collecting thousands of crores of government sponsored insurance premium, meant for the farmers and underprivileged, thereafter opening fake bank a/c's and claiming insurance benefits.

B. In connivance with notorious MLM companies selling PONZI schemes to vegetable vendors, daily wage earners, domestic helps, petty shopkeepers etc... in the process scamming off the insurance premiums, paid by them. And this criminality was patronised by Deepak Sood incidentally who got appointed as a whole Time Board Member of Insurance Regulatory & Development Authority (IRDA).

C. Collecting premium from PSU companies and issuing policies in the name of employees of the insurance companies.

Given the context and extent of cheating, any advocate worth his salt of integrity, through bluffs would not have thwarted investigation by law enforcement agencies, prayed through a Criminal PIL 2/2017, regretfully this is what Sr. Advocate Kamat did -

A. On 11th Sept’ 2024, the Cr. PIL, was listed before Justices, Revati Mohite Dere & Prithviraj Chauhan, who in their sagacity directed the counsels for the investigative agencies to seek directions as to whether the writ petitions can be treated as complaint for conducting investigation and the matter was adjourned for 25th Sept 2024.

B. On 25th Sept 2024, Sr. Advocate Ashish Kamat jet-set appeared and set in motion his childish tricks of bluffing the court, befitting a juvenile intern - that the petitioners have not approached the court with clean hands, suppressed the fact that similar issues in the subject Cr. PIL was dismissed by Hon’ble Bombay High Court in their order dt/- 14th Aug’ 2014. The bizarre falsity indulged by Kamat, raises serious concern of his mental health and professional integrity, since Cr. PIL 2/2017 originally was registered as PIL 97/2013 in Aug’ 2013 and none can suppress an event of 2014 in 2013. Kamat in his binge of bluffing did not even care to come clean, that the order of 2014 never dealt with issues of -

a. Defrauding the government in collecting thousands of crores of premium by enrolling bogus beneficiaries etc…

b. Taking premium from PSU’s meant for employee benefit corpus but issuing policy in the name of insurance company employees.

c. Selling PONZI schemes through dubious MLM companies to the poor and cheating their premium, through fake expenses bills.

Given the high decibel bluffing by Ashish Kamat, the matter was twice adjourned to 18th Oct 2024 and 19th Nov’ 2024. In the meanwhile, an application was filed in Bombay High Court, seeking action of contempt against Kamat for his conduct. Kamat realising his deceit has been exposed did not attend the proceedings on 19th Nov’ 2024 and Hon’ble Justices Revati Mohite Dere and Prithviraj Chauhan proceeded to adjourn the proceedings due to his non-attendance, although granting the said adjournment, is puzzling and against the settled position of law.

Ashish Kamat, in his quest for making moolah by any means ‘fair or foul’ lost sight of the poor victims who are below his radar and have been collectively cheated of thousands of crores but justice is elusive to them by Kamat’s deception, prompting Adv. Vijay Kurle to file an application in Bar Council of Maharashtra & Goa (BCMG) to take suo motu action against Ashish Kamat, who is (mis)using his senior counsel gown to bring disgrace to the nobility of the profession of advocacy. Legal fraternity keenly awaits the action by BCMG, including recommendation to strip his senior counsel gown, which will send a strong message of deterrence to the mighty, who are out to protect the white collared social parasites.
