SENIOR
ADVOCATES OF BOMBAY HIGH COURT AMIT DESAI AND ASHISH KAMAT POTENTIALLY TO FACE CONTEMPT
PROCEEDINGS
Dr.
Udit Raj (Ex-Loksabha MP) and noted dalit leader & National Chairman of All India Confederation of
SC/ST Organisation And Sh. Ashok Jain, noted Trade Unionist had filed Criminal
Writ Petitions for taking action against Private Insurance Companies – ICICI
Lombard, Future Generali Insurance, Bajaj Allianz Insurance And Bharti Axa for
having siphoned thousands of crores of Government Funds by bogus enrolment of
policyholders, opening of fake bank accounts, Cheating Policy Holder’s money through fake
billing, Collecting Premium from PSU’s but issuing policy in the name of
Insurance Company Agents and passing huge agency commission and circumventing
FDI guidelines by roundtripping of funds through shell companies in foreign
‘Tax Havens’.
Strangely, Sr. Adv. Amit Desai baselessly claimed before the Court, all allegations have been investigated by CBI Rajasthan and no criminality was found. Yet thousands of crores of rupees meant for the farmers and the poorest sections of the society, never reached them. Reminds *NO ONE KILLED JESSICA BUT JESSICA WAS KILLED*
Multiple
Complaints were made to Insurance Regulatory & Development Authority (IRDA)
against the insurance companies, either it fell in the deaf ears or at best IRDA
levied paltry fines and gave some friendly warnings, though the law provided
imposing penalty of thousands of crores and registration of the insurance
companies were liable for cancellation. Such lenience could not have been shown, unless the IRDA officials were well cared by the private insurance
companies, else it is mysterious for RK Nair the erstwhile IRDA member acquiring
disproportionate assets including flats in Mumbai worth multiple crores and
being provided a director level posting in ICICI group Company. To top it all,
CeO of the scamming insurance company Dipak Sood, who patronised, selling
of MLM products through dubious chain marketing companies and scamming the
policyholders of their premium amount was made whole time member of
IRDA.
Legal
Head of Future Generali attempted bribing and intimidating the petitioner of
dire consequences if anything goes wrong, and also boasted about himself that
due to his connections with Judges, Senior Counsels, of Bombay High Court, he
will anyhow get the writ petitions dismissed, the threat was noticeable
during court proceedings on 25.09.2024, before the Hon’ble Court of Justices
Revati Mohite Dere & Prithviraj Chauhan when Senior Advocate Ashish
Kamat bluffed the court that the issues similar in the Writ Petition is already
adjudicated and dismissed. In the same breath surprisingly either due to
his ignorance of law or to mislead the court, Ashish Kamat raised the issue
of locus in Criminal Proceedings, even a first-year law intern is
aware that the concept of locus is alien in criminal proceedings, Advocate Ashish
Kamat simply tricked the court in making submissions in contempt of rulings of Hon.
Courts. Somehow the proceedings on 25.09.2024 was adjourned, though
Hon’ble Justices Revati Mohite Dere & Prithviraj Chauhan were earlier
inclined to treat the Writ Petitions as Complaint.
Due to the misconduct on the part of Senior Advocates AMIT DESAI AND ASHISH KAMAT, Dr. Udit Raj wrote a letter to Hon. Chief Justice of Bombay High Court, copied to Hon. Chief Justice of India, Secretary, Bombay Bar Association and Bar Council of Maharashtra & Goa to take strict action against the Senior Advocates. Also Adv. Nicky Pokar filed a Contempt Petition against the said senior advocates. All these allegation will be heard soon by the court.
