Corruption Case Against SEBI Chairman Madhabi Buch At Mumbai ACB Court to Favour Cals Refineries Limited
Mumbai: Corruption case is filed against SEBI Chairman Madhabi Buch and BSE Officers under section 7 and 13 of Prevention Of corruption act at Anti corruption Bureau Court . The Complainant approached SEBI Chairperson Ms Madhabi Buch for crime in listing of Cal refineries Share at BSE . The BSE Listed Cals Refinery share without SEBI NOC on 13 Dec 1994. The SEBI did not taken any action as per section 15 HA and Company act against Cals Refineries and BSE . Due to this crime complainant cum investor has lost huge money . SEBI Chairperson ignored the complaint and did not taken as action per Securities and Exchange Board of India (Procedure for Holding Inquiry and Imposing Penalties) Rules, 1995. She hold the compliant for more then 5 months to benefit company and not appointed Adjudicating Officer (AO).
The corruption complaint was registered to ACB and CBI Mumbai under CRPC 154. When both the agencies did not responded, the CRPC 156 Complaint is filed before ACB/CBI court Mumbai to register FIR Under IPC 166 A,etc and under Section 7 and 13 of PC 1988. Recently SEBI chairman appeared through advocate in this case before ACB Court Mumbai. As per Complainant SEBI Chairman has taken advantage to avoid action in the company and BSE crime under section 15 HA of SEBI act 1992. The complainant also has disproportionate assets allegation against SEBI chairperson . As per Supreme court order Charan Singh Case Preliminary enquiry is mandatory in disproportionate assets allegation case . Complainant says that SEBI is doing selective investigation on complaint and disobeying rule of law and various apex court order . As she did not follow the rule of law so section 17 A protection is not applicable to protect her from preliminary enquiry .
As per ROC reply Cals refineries is facing SFIO enquiry but it has nothing to do with investors . By doing fraud with investors BSE and Cal Refineries cheated millions of investors .It is the duty of SEBI to protect the interest of investors but they keep silent on complaint and take action as per face value. SEBI is the hub of corruption and money making machine for many officers . Any person can file corruption complaint at ACB Court of their District against such delinquent officers under PC act 1988.
After 5th July 2024 the judge was changed and the new judge need time to read complaint and SEBI provisions. As per Rajasthan High Court order there is no bar to register FIR under PC act 1988 . The court have option to call report from ACB Mumbai or Direct FIR as per SC Lalita Kumari constitutional order . Matter will be heard soon by ACB court. SEBI in past taken action against MS Just Reliable Projects India Limited for issuing shares without SEBI compliance under SEBI and company act . SEBI also directed company to refund money with 18% return to investors. As per SC order there is no immunity from investigation including judges . Only President and Governor is having immunity from investigation.

By way of the application, he is seeking direction for investigation through ACB/CBI by registering an offence u/sec. 166(a)(b), 120-B, 420 and 409 of IPC and u/sec. 7 & 13 of The prevention of Corruption Act. 2.Perusal of complaint reveals applicant is seeking registration of an FIR against applicant No.1 who is the Chairperson of SEBI, accused Nos.2 to 4 Whole Time Member of SEBI, accused No.5 Chairman and Public Interest Director (BSE), accused No.6 Sundaraman Ramamurthy, MD and CEO (BSE). Whereas, party Nos.7 and 8 are the State of Maharashtra and of India. 3.According to complainant accused Nos.1 to 6 are public servants. He and his family had invested in the shares of Cals Refineries Ltd.on 13.12.1994, which is listed at BSE India. The accused Nos.1 to 6 by neglecting crime of Cals Refineries Ltd., fraudulently listed it against rule of law and failed to protect the interest of investors by taking bribe and various advantage. Due to it, he suffered huge loss in Cals shares. Thus prayed for passing order against accused Nos.1 to 6.4.Perusal of the complaint as well as the argument advanced by the complainant in person, reveals that he his leveling allegations of corruption against the Chairman, MD, CEO and other members of SEBI and BSE. 5.The assignment and sitting arrangement of the Judicial officer and the Court is made by the Honble Principal Judge. As per the Office Order dated 07.06.2024 assignment of SEBI cases is allotted to the Judicial Officer of Court Room No.22. Whereas, this Court is specifically allotted ACB (Anti-Corruption Bureau) cases. As such question arise whether this Court can entertain and decide the application.Considering the clear-cut Office Order regarding the assignment, I am of the view that this Court has no jurisdiction to entertain and decide the present application. Therefore, it will be just and proper to seek guidance of Honble Principal Judge.
