Palghar: A consumer of MSEB has filed Police complaint to register FIR against Electricity officers SDO Kolhe and SE Kiran Nagaonkar under IPC 420,166a,218,34,for offence in the color of dress. As per complainant the MSEDCL officers removed the meter without notice and violated rule 56 of Electric Act .The licensee does not claim that it has given 15 days notice under section 56 (1) of E. Act 2003 before disconnection or stopping of supply. Therefore such disconnection without giving such 15 days notice is illegal.
In the color of dress the officers done crime which is cognizable offence as per SC Lalita Kumari Order . The Palghar Police has verbally denied to register FIR against against MSEDCL officer in the name of brotherhood and done contempt of lalita Kumari guidelines. The police officers will have to pay for contempt when contempt case will be filed before JMFC. Supreme court directed Magistrates to take contempt action for violation of lalita Kumari guidelines. Now the complainant will comply CRPC 154(3) provision and file Criminal complaint before JMFC Palghar under CRPC 156(3) by next week.The JMFC may direct FIR ie Investigation for the crime done by public servant in the color of dress. The protection of CRPC 197 will not work that it is not their part of duty to disconnect meter without notice.
